1. What is Vietnam Investment Visa?

Investment visa is a type of visa granted to foreign investors or representatives of foreign organizations investing in establishing or contributing capital to enterprises and companies in Vietnam.

According to the law, Vietnam investment visa is denoted as DT visa.

Investment Visa is the money for foreigners to apply for a temporary residence card in Vietnam, valid for up to 10 years.

2. Types of Vietnam visa and validity period

According to the regulations on investment visas for foreigners, specifically the Law on entry, exit, transit and residence of foreigners in Vietnam No. 51/2019/QH14, Vietnam investment visa is granted divided into 4 classes with different validity periods, depending on the value or nature of the investment.

*Visa ĐT3*	Maximum 3 years	Issued to foreign investors in Vietnam and representatives of foreign organizations investing in Vietnam with a contributed capital of between VND 3 billion and under VND 50 billion.
*Visa ĐT4*	Maximum 12 months	Issued to foreign investors in Vietnam and representatives of foreign organizations investing in Vietnam with a contributed capital of less than VND 03 billion.

3. Benefits of owning a Vietnam investment visa

Foreign investors who are granted a Vietnam investment visa will enjoy the following specific benefits:

Long-term stay in Vietnam according to the validity period of the investment visa;
Continue to be extended under the investment visa after the visa expires;
Get a temporary investment card with a term of up to 10 years (applicable to DT1, DT2 and DT3 investment visas).

4. Conditions for applying for an investment visa for foreigners

Conditions to apply for an investment visa for foreigners include:

Foreign investors with valid Passports as prescribed,
Foreign investors have guaranteed agencies or organizations in Vietnam,
Have documents to prove that you are an investor. That document could be:

o Business License/Investment License

o Certificate of capital contribution/shares in the enterprise; or

o another relevant document proving that the foreigner is an investment category in accordance with the law on enterprises and investment of Vietnam.

5. Where to apply for investment visa for foreigners?

The place to apply for a Vietnam investment visa will depend on whether the foreign investor is in Vietnam or abroad.

If in Vietnam: apply for an investment visa at the Vietnam Immigration Department,
If you are abroad: apply for an investment visa at the Vietnamese Embassy/Consulate in a foreign country or at the border gate upon entry after obtaining a written approval from the Immigration Department of Vietnam.

The specific process of each way to apply for a Vietnam visa for foreign investors is presented below.

6. Procedures for applying for an investment visa for foreigners

Depending on whether the foreign investor is in Vietnam or abroad, the documents and steps for making an investment visa for foreigners will also be different.

6.1 Procedures to apply for a DT visa if the foreign investor is abroad

If the person who needs to apply for a visa to visit Vietnam relatives is abroad, the visa application process will be done as follows:

👉 Step 1: Apply for an investment visa

The company in which foreigners contribute capital/invest will prepare a set of investment visa application documents including:

01 certified copy of business registration certificate or investment certificate or decision of a competent authority on the establishment of the organization
Sample introduction of seal, signature of authorized person of the company (Form NA16);
Photocopy of the foreign investor’s passport;
Notarized copy of Investment Certificate.
Letter of guarantee (Form NA2 with barcode, declared here);

Then, the representative of the guarantee company will submit the application at one of the following addresses:

Hanoi Immigration Department: 44-46 Tran Phu Street, Ba Dinh District, Hanoi
The Immigration Department of Ho Chi Minh City. Ho Chi Minh City: 333-335-337 Nguyen Trai Street, District 1, City. Ho Chi Minh
Danang Immigration Department: 78 Le Loi, Thach Thang, Hai Chau, Da Nang

After submitting the application, the applicant will receive a receipt (also called an appointment letter). The applicant will have to wait about 5 working days for the immigration agency to process the application.

Finally, the Immigration Department will issue the Official Letter of Entry to Vietnam.

At that time, the guarantee company will scan the entire document and send it to the foreign investor, so that the foreign investor can stamp the phone visa to enter Vietnam.

👉 Step 2. Paste Vietnam phone visa

When receiving a scanned copy of the entry letter, the foreign investor will need to prepare:

The original passport is valid and must have at least 2 blank pages (the same passport used to apply for a visa to enter Vietnam);
2 4×6 photos with white background;
Printed copies of all entry documents;
Application for entry and exit from Vietnam.

After that, depending on the place to apply for a visa to visit relatives in Vietnam, foreigners will bring the documents

Registered Vietnamese Embassy/TLSQ; or
Registered Vietnam entry border gate

to paste the investment visa and complete the entry procedures to Vietnam under the investment category.

6.2 If the foreign investor is in Vietnam

In this case, the guarantee company will take the following steps to apply for an investment visa for foreigners, also known as converting the purpose of a Vietnam visa, from the current visa to the investment visa.

Step 1: Prepare and submit your application

The company that guarantees foreign investors to apply for a Vietnam visa will prepare a set of documents including the following documents:

01 certified copy of business registration certificate or investment certificate or decision of a competent authority on the establishment of the organization
Sample introduction of seal, signature of authorized person of the company (Form NA16);
Notarized copy of Investment Certificate.
Original passport of foreign investor and valid visa/temporary residence card;
Application form for visa and temporary residence extension for foreigners in Vietnam (Form NA5)
A copy of temporary residence registration as prescribed (See Instructions on temporary residence registration for foreigners in Vietnam).

After that, the representative of the guarantee company will bring the documents to submit at

Hanoi Immigration Department, or
Ho Chi Minh City Immigration Department; or
Danang Immigration Department.

The applicant will then receive a receipt with an appointment date of the results.

👉 Step 2: Get the result

On the appointment date, the representative of the guarantee company will bring the appointment letter to the application site to receive the investment visa result.

From that point on, foreigners will be able to stay in Vietnam under the investment visa category.

1. Visa đầu tư Việt Nam là gì?

Visa đầu tư là loại visa được cấp cho các đối tượng là nhà đầu tư nước ngoài hoặc người đại diện cho các tổ chức nước ngoài đầu tư thành lập hoặc góp vốn vào doanh nghiệp, công ty tại Việt Nam.

Theo quy định của pháp luật, visa đầu tư Việt Nam được ký hiệu là visa ĐT.

2. Các loại visa ĐT Việt Nam và thời hạn hiệu lực

Theo quy định về thị thực đầu tư cho người nước ngoài, cụ thể là luật xuất nhập cảnh, xuất cảnh, quá cảnh, cư trú của người nước ngoài tại Việt Nam số 51/2019/QH14, thị thực đầu tư Việt Nam được chia thành 4 loại có thời hạn hiệu lực khác nhau, tùy vào giá trị hoặc tính chất của hoạt động đầu tư.

Visa ĐT4	Tối đa 3 năm	Cấp cho nhà đầu tư nước ngoài tại Việt Nam và người đại diện cho tổ chức nước ngoài đầu tư tại Việt Nam có vốn góp giá trị từ 03 tỷ đồng đến dưới 50 tỷ đồng.
Visa ĐT4	Tối đa 12 tháng	Cấp cho nhà đầu tư nước ngoài tại Việt Nam và người đại diện cho tổ chức nước ngoài đầu tư tại Việt Nam có vốn góp giá trị dưới 03 tỷ đồng.

3. Lợi ích khi sở hữu visa đầu tư Việt Nam

Những nhà đầu tư nước ngoài được cấp visa đầu tư Việt Nam sẽ được hưởng những lợi ích cụ thể như sau:

Được lưu trú dài hạn tại Việt Nam theo thời hạn hiệu lực của visa đầu tư;
Tiếp tục được gia hạn theo diện visa đầu tư sau khi visa hết hiệu lực;
Được làm thẻ tạm trú đầu tư có thời hạn lên đến 10 năm (áp dụng với visa đầu tư ĐT1, ĐT2 và ĐT3).

4. Điều kiện xin visa đầu tư cho người nước ngoài

Điều kiện để xin visa đầu tư cho người nước ngoài bao gồm:

Nhà đầu tư nước ngoài có Hộ chiếu còn hiệu lực theo quy định,
Nhà đầu tư nước ngoài có có cơ quan, tổ chức tại Việt Nam bảo lãnh,
Có giấy tờ chứng minh mình là nhà đầu tư. Giấy tờ đó có thể là:
- Giấy phép kinh doanh/Giấy phép đầu tư
- Giấy chứng nhận phần vốn góp/cổ phần tại doanh nghiệp; hoặc
- một giấy tờ tài liệu khác có liên quan chứng minh người nước ngoài là diện đầu tư theo quy định của pháp luật doanh nghiệp và đầu tư Việt Nam.

5. Nộp hồ sơ xin visa đầu tư cho người nước ngoài ở đâu?

Địa điểm xin visa đầu tư Việt Nam sẽ phụ thuộc vào việc nhà đầu tư nước ngoài đang ở Việt Nam hay ở nước ngoài.

Nếu ở Việt Nam: xin visa đầu tư tại Cục quản lý Xuất nhập cảnh Việt Nam,
Nếu ở nước nước ngoài: xin visa đầu tư tại Đại sứ quán/Tổng lãnh sự quán Việt Nam tại nước ngoài hoặc tại cửa khẩu khi nhập cảnh sau khi đã có công văn đồng ý cấp visa của Cục xuất nhập cảnh Việt Nam.

6. Thủ tục xin visa đầu tư cho người nước ngoài

Tùy vào việc nhà đầu tư nước ngoài đang ở Việt Nam hay nước ngoài, mà hồ sơ và các bước làm visa đầu tư cho người nước ngoài cũng sẽ khác nhau.

6.1 Thủ tục xin visa ĐT nếu nhà đầu tư nước ngoài đang ở nước ngoài

Nếu người cần xin thị thực tại Việt Nam đang ở nước ngoài, quy trình xin visa sẽ được thực hiện như sau:

👉 Bước 1: Xin công văn nhập cảnh diện đầu tư

Công ty mà người nước ngoài góp vốn/đầu tư sẽ chuẩn bị bộ hồ sơ xin visa đầu tư bao gồm:

01 Bản sao có chứng thực giấy ĐKKD hoặc giấy chứng nhận đầu tư hoặc quyết định của cơ quan có thẩm quyền về việc thành lập tổ chức
Mẫu giới thiệu con dấu, chữ ký của người có thẩm quyền của công ty (Mẫu NA16);
Photo hộ chiếu của nhà đầu tư nước ngoài;
Bản sao y công chứng Giấy chứng nhận đầu tư.
Công văn bảo lãnh (Mẫu NA2 có mã vạch, được khai tại đây);

Sau đó, đại diện công ty bảo lãnh sẽ nộp hô sơ tại một trong các địa chỉ sau:

Cục Quản lý Xuất nhập cảnh Hà Nội: 44-46 đường Trần Phú, quận Ba Đình, Hà Nội
Cục Quản lý Xuất nhập cảnh TP. Hồ Chí Minh: 333-335-337 đường Nguyễn Trãi, Q1, TP. Hồ Chí Minh

Nộp hồ sơ xong, người nộp sẽ nhận được giấy biên nhận (cũng gọi là giấy hẹn). Người nộp sẽ phải chờ khoảng 5 ngày làm việc để cơ quan xuất nhập cảnh xử lý hồ sơ.

Cuối cùng, Cục quản lý xuất nhập cảnh sẽ cấp Công văn nhập cảnh Việt Nam.

Khi đó, công ty bảo lãnh sẽ scan toàn bộ công văn này gửi cho nhà đầu tư nước ngoài, để nhà đầu tư nước ngoài có thể dán tem visa ĐT để nhập cảnh Việt Nam.

👉 Bước 2. Dán visa ĐT Việt Nam

Khi nhận được bản scan công văn nhập cảnh, nhà đầu tư nước ngoài sẽ cần chuẩn bị:

Hộ chiếu bản chính còn thời hạn và phải còn ít nhất 2 trang trắng (chính là hộ chiếu được dùng để xin công văn nhập cảnh Việt Nam);
2 ảnh 4×6 phông trắng;
Bản in tất cả các trang công văn nhập cảnh;
Đơn xin nhập xuất cảnh Việt Nam.

Sau đó, tùy vào địa điểm xin lấy visa , người nước ngoài sẽ mang hồ sơ đến

ĐSQ/TLSQ Việt Nam đã đăng ký; hoặc
Cửa khẩu nhập cảnh Việt Nam đã đăng ký

để dán visa đầu tư và hoàn thành thủ tục nhập cảnh Việt Nam theo diện đầu tư.

6.2 Nếu nhà đầu tư nước ngoài đang ở Việt Nam

Trong trường hợp này, công ty bảo lãnh sẽ thực hiện các bước sau đây để xin visa đầu tư cho người nước ngoài, hay còn gọi là chuyển đổi mục đích visa Việt Nam, từ loại visa hiện tại sang visa đầu tư.

👉 Bước 1: Chuẩn bị và nộp hồ sơ

Công ty bảo lãnh nhà đầu tư nước ngoài xin visa ĐT Việt Nam sẽ chuẩn bị bộ hồ sơ bao gồm các giấy tờ sau:

01 Bản sao có chứng thực giấy ĐKKD hoặc giấy chứng nhận đầu tư hoặc quyết định của cơ quan có thẩm quyền về việc thành lập tổ chức
Mẫu giới thiệu con dấu, chữ ký của người có thẩm quyền của công ty (Mẫu NA16);

Sau đó, đại diện công ty bảo lãnh sẽ mang hồ sơ tới nộp tại

Cục quản lý Xuất nhập cảnh Hà Nội, hoặc
Cục quản lý Xuất nhập cảnh thành phố Hồ Chí Minh; hoặc
Cục quản lý Xuất nhập cảnh Đà Nẵng.

Sau đó, người nộp sẽ nhận được biên lai hẹn ngày nhận kết quả.

👉 Bước 2: Nhận kết quả

Vào ngày hẹn, đại diện của công ty bảo lãnh sẽ mang giấy hẹn lên địa điểm nộp hồ sơ để nhận kết quả visa đầu tư.

Từ thời điểm đó, người nước ngoài sẽ được lưu trú tại Việt Nam theo diện visa đầu tư.
